COMPLETE SUMMARY OF TENTATIVE AGREEMENT

    Contract term is 10/1/2007 through 9/30/2010
  • 5% salary increase- retro active to July 1, 2007 ( to be paid on separate check by pay period 24)
  • 5% salary increase effective July 1, 2008
  • 6% salary increase effective July 1, 2009
  • $1500 contribution to employees deferred comp account on Jan 2, 2008 (employees may elect to have as cash in-lieu of deferred comp)
  • July 1, 2007- 12% salary adjustment for Paralegal classification
  • Real Time differential increased to 5% non certified 10% certified ( currently 3% / 5%)
  • Health insurance subsidy:
  • July 2007 –June 2008 Court to continue subsidy at current rates (subsidy ranges 100% to 93%)
  • 2008-2010 “Employee only” subsidy at 100% of highest HMO rate
  • 2008-2010 “Employee plus one” and “Employee plus two or more”:
  • July 2008- June 2009 Court to pay current plus amount equal to: first 7% of any rate increase to Kaiser rate plus 80% of any increase over first 7%
  • July 2009- July 2010 Court to pay 2008 rate plus amount equal to first 5% of rate increase to Kaiser rate plus 80% of any increase over first 5%
  • July 2010 - Court to pay 100% of any health plan premium increases pending negotiations for the next contract. (the next contract will begin 10/1/2010)
  • July 1, 2008 Improvement to Catastrophic leave program including ability to donate sick leave
  • Retiree health plan and subsidy guaranteed in contract, 10/1/07 $50 per month increase in subsidy; July1 2008 additional $50 per month increase in retiree subsidy
  • Orthodontic benefit life cap increases to $2500 (currently $1500)
  • Vision insurance remains 100% paid by Court
  • $50,000 Life insurance for employee premium paid by court (currently $15,000) keeps $5000 for dependents
  • New employer-paid Long Term Disability coverage for employees who work ½ time or more
  • Court Attendant Clothing allowance increases to $700 per year (from current $450)
  • Improve the transfer process
  • Protection against contracting out of jobs except for short term staffing shortages or special projects
  • Improve ergonomic Review and implementation process
  • Labor / Management Committee on Employee Safety
  • Employee access and copies of their supervisors desk file (hard copy or electronic)
  • Family Death Leave – adds aunt, uncle, spouse or domestic partner of your child
  • Job protections for employees who are victims of Domestic Violence
  • Addition benefits and Incorporates provisions of law into contract allowing use of leave, make-up time or dock time to participate in child’s school events or programs.
  • Enhancement to Paid Family Leave – incorporates provisions of law into contract and for additional rights to return to job and assignments.
  • Effective Jan 1, 2008, Reimbursement for extra child care costs if employee mandated to overtime, up to $60 per overtime incidents. Must provide receipt for costs from licensed child care provider.
  • Education/Tuition Reimbursement: Increased to $2400 per year, pro-rated for part-time employees
  • Transit Subsidy: 80% of cost up to maximum of $110 per month. Maximum increase if IRS allowable rate increase in future years.
  • 1 new floating holiday per year, paid off in cash if not used by pay period 24 (Effective Jan 1, 2008)
  • 5% Training differential for actual time assigned to do training when assigned by supervisor for 2 or more hours per pay period
  • 10% Training differential for time assigned by supervisor to do structured training (prepares training materials and provides training to a group of employees)
  • License fees reimbursed when license is REQUIRED for job classification
  • Creation of Healthy Workplaces project
  • Redo classification studies with union input and control on process, salary negotiations upon completion
  • Mandates accurate payroll records and Employee right to comprehensive quarterly review on paid time
  • 5% Special Projects differential when assigned to a special project such as CCMS
  • Court Reporter Transcript pay on separate checks/ reported on 1099s
  • 2 days of Paid Transcript Preparation time between now and March 31 with plan to work out rest of year.
  • Protection of Court Attendant positions
  • At least 5 Court Reporters at a time on vacation from now through March 31
  • Ability to purchase additional retirement service credits – employee pays full cost
  • Plan to work out improved vacation policy for all employees
  • Labor management Committee on Employee Career Development
  • Commitment to create enhanced retirement during this contract
  • Create an appeal process for classification studies, allocations of positions and promotional exams/lists

    UPE and the Courts have a genuine commitment to continue working together to solve problems and make the Courts a well-functioning, great place to work. There are several joint labor/management committees to be formed to work on a wide variety of issues. This will give UPE members and the union an opportunity to participate directly in creating positive change, and finding needed solutions in many areas, including : Healthy workplace program, vacation scheduling, workplace safety.

    There will be a membership meeting to review all the provisions of the tentative agreement on Wednesday October 17, 2007 at 6:00 pm at the UPE office. A complete summary and the wording of the contract will be available next week. Details of the ratification vote are being worked out, but the vote will be held AT YOUR WORKSITE DURING WORK HOURS sometime after the contract explanation meeting on Oct 17.

    Your Negotiations Team unanimously supports this agreement and recommends a YES vote on Ratification.
